Terms of Service

These Terms of Use ("Terms") govern your access to and use of the Vibe Science mobile application (the "App"), associated hardware device (the "Device"), and related services (collectively, the "Services").

References to "VS Shift" or "SHIFT" in these Terms mean Vibe Science products and are included within the Services.

By creating an account, accessing, or using the App, Device, or Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Who We Are

"Vibe Science," "we," "us," or "our" refers to Vibe Science Pte. Ltd., a company incorporated in Singapore.

Eligibility

You may use the Services only if:

  • You are at least 18 years old;
  • You are legally capable of entering into a binding agreement; and
  • You have reviewed and acknowledged the safety information provided during onboarding.

You may not create more than one account.

Nature of the Services

The Services provide light- and audio-based sessions intended to support relaxation, focus, and general wellness.

The Services are not intended to diagnose, treat, cure, prevent, or monitor any disease or medical condition.

The Services are not medical advice and are not a substitute for professional healthcare. Always consult a qualified medical professional regarding medical concerns.

Safety Disclaimer

You must not use the Services if you or a close family member have:

  • Photosensitive epilepsy; or
  • Juvenile myoclonic epilepsy.

The Services may trigger migraines, visual discomfort, or motion sensitivity.

Consult a healthcare professional before use if you:

  • Are pregnant;
  • Have suffered a stroke;
  • Take antidepressants or antibiotics;
  • Use recreational drugs; or
  • Have any neurological or psychiatric condition.

Do not use the Services while driving, operating machinery, or performing tasks requiring attention.

You assume full responsibility for your use of the Services.

Account Registration

To access certain features, you must create an account.

You agree that:

  • All information you provide is accurate and current;
  • You will maintain the confidentiality of your login credentials;
  • You are responsible for all activity under your account.

You may delete your account at any time within the App or by contacting support@vibescience.co.

We reserve the right to suspend or terminate accounts that violate these Terms.

License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use the App for personal, non-commercial purposes; and
  • Use the Device as intended.

You may not:

  • Copy, modify, or distribute the App;
  • Reverse engineer or attempt to extract source code;
  • Resell or commercially distribute the Services;
  • Circumvent technical safeguards.

All intellectual property rights remain the property of Vibe Science or its licensors.

Third-Party Integrations

The App may allow you to connect third-party services (such as Oura or WHOOP).

By connecting a third-party service:

  • You authorize us to access the data you permit through that integration;
  • You represent that you have the right to share such data;
  • You acknowledge that the third party's terms and policies also apply.

You may disconnect integrations at any time within the App.

We are not responsible for the operation, availability, or policies of third-party services.

Subscriptions and Payments

The Services may include free features and paid subscription options.

Subscriptions automatically renew unless canceled before the renewal date.

If you purchase a subscription through Apple App Store or Google Play, payment processing and refunds are governed by their respective terms.

Unless required by law, subscription fees are non-refundable once access has been granted.

You may cancel your subscription through your app store account settings.

Privacy

Your personal information is handled in accordance with our Privacy Notice, available within the App and on our website.

By using the Services, you consent to the data practices described in the Privacy Notice.

Disclaimers

The Services are provided "as is" and "as available."

We do not guarantee that:

  • The Services will be uninterrupted or error-free;
  • The Services will achieve specific outcomes;
  • The Services will be compatible with all devices.

To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages;
  • We are not liable for loss of profits, data, or business interruption;
  • Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable law.

Program-Specific Terms

If you participate in a specific program, beta test, pilot, research initiative, or other initiative that requires you to execute additional or separate terms, agreements, or acknowledgments, those program-specific terms will apply in addition to these Terms.

In the event of any conflict or inconsistency between these Terms and the signed program-specific terms, the program-specific terms shall prevail to the extent of the conflict.

Termination

We may suspend or terminate your access if:

  • You materially breach these Terms;
  • You misuse the Services;
  • We are required to do so by law;
  • We discontinue the Services.

You may stop using the Services at any time.

Governing Law and Jurisdiction

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

You agree that any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Singapore.

If you are a consumer residing outside Singapore, you may also have mandatory rights under the laws of your place of residence.
